Proof of Service with ABC Legal Services

ABC Legal will provide proof of service upon completion of a successful serve. We will provide proof of non-service if due diligence was met but successful service could not be effected.

A proof of service, also known as an affidavit of service (when notarized), return of service, or a declaration of service, is a sworn statement from a process server attesting to when, where, and upon whom service was effected.

Where is my proof of service?

Once your case is served and your proof of service is available, you can find it as a PDF in your secure account. Download it by navigating to the Case Details page associated with your order. We will notify you by email, SMS*, or, if applicable, through your integration in Litify or Clio once the signed copy is available unless you have changed your notification preferences.

Please note:

• If your case is at a court that requires a physical copy (sometimes called a "wet ink original"), the proof of service will be mailed to you. The process server should send it within a few days of signing the proof.
• In cases requiring notarization, your process server may need additional time to present the document and have it signed in front of a notary. You may have to wait an additional two weeks to receive notarized proofs.

What to do with your proof of Service

To complete service of process, you will need to file the proof of service. ABC Legal will provide you with proof of service in the format the court requires.

• If you can file digitally or if the original document is not required, you can use the PDF provided in your secure account.
• If you must file the original, it will be mailed to you.
• If you must file a notarized proof, it will also be mailed to you.

Depending on the kind of proof required, you must either file online (eFile) or in person (physical or over-the-counter filing). Typically, proof filing follows the same process and procedures observed when filing the case initially with the court.
